Terms of Service

Spritzy is an online marketplace that connects people buying and selling pre-loved fragrance — decants and full bottles. Spritzy is not the seller of the items listed. Sellers are independent individuals who own and are responsible for the items they list. We provide the platform, the listing tools, and payment processing; we do not take possession of, inspect, or ship the goods.

Where required by law, Spritzy acts as a marketplace facilitator for the collection and remittance of applicable sales tax on transactions completed through the platform.

You must be at least 18 years old and able to form a binding contract to use Spritzy. You are responsible for the activity on your account and for keeping your login secure. You agree to provide accurate information and to keep it current.

• You may only list items you legally own and have the right to sell.
• You must describe each item honestly and accurately, including its fill level, condition, and history. Spritzy does not currently authenticate or independently verify listed items; descriptions are the seller's own representations.
• You may not list counterfeit, replica, or misrepresented goods. See our Prohibited & Restricted Items policy.
• To receive payouts, sellers complete onboarding with our payments provider (Stripe). Spritzy charges a platform fee on each completed sale, disclosed at the point of listing and checkout.

At launch, shipping is managed entirely by the seller. Spritzy does not provide labels, tracking, or carrier integration.

• United States only. Checkout is restricted to US shipping addresses. We do not currently support international orders.
• Ground shipping only — no air. Fragrance is a flammable liquid subject to carrier and DOT/IATA hazardous-materials rules. Sellers must ship by approved ground methods only and must comply with all applicable packaging, labeling, and carrier requirements. Sellers acknowledge these obligations before listing.
• The seller bears the cost and responsibility of shipping, including packaging items safely and dispatching them promptly (generally within 3 days of sale).

Spritzy is not the shipper and is not responsible for items damaged, delayed, or lost in transit. See the Returns & Refunds policy for how disputes are handled.

Payments are processed by Stripe. We do not operate a managed escrow service — funds are not held by Spritzy until a buyer confirms receipt. Seller payouts may be subject to a short delay or reserve so that funds remain recoverable if a payment is disputed or refunded.

If a payment is refunded or a chargeback/dispute is resolved against a sale, Spritzy reverses the corresponding transfer and platform fee. The seller is responsible for the refunded amount, and you authorize us to recover it from your balance, future payouts, or payment method.

Taxes are your responsibility.Spritzy is a payment facilitator, not your tax adviser. You are solely responsible for determining, reporting, and paying any income, self-employment, and sales tax owed on your sales. Where the law requires a Form 1099-K, it will reflect your gross sales before Spritzy's platform fee.

When you buy, you are entering into a transaction with the seller, not with Spritzy. Because items are pre-loved and seller-described, please read listings carefully. If something arrives not as described, contact us promptly (see Returns & Refunds).

The platform is provided "as is." To the fullest extent permitted by law, Spritzy is not liable for the acts or omissions of buyers or sellers, the authenticity, quality, safety, or legality of listed items, or losses arising from shipping. Our aggregate liability for any claim is limited to the platform fees we earned on the transaction giving rise to the claim.

You agree to indemnify and hold Spritzy harmless from claims, losses, and expenses arising out of your listings, your sales or purchases, your shipping, or your breach of these terms.
